Terms of Service

Welcome to Moringa.co (“Moringa.co”, “we”, “our”, or “us”). These Terms of Service (the “Terms”) govern your access to and use of the website moringa.co (the “Site”), and any related products, services, content, or features offered by Moringa.co (collectively, the “Services”). By accessing the Site or using the Services, you agree to these Terms. If you do not agree, please do not use the Site or Services.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site, place an order, or enroll as a Brand Partner. By using the Services, you represent and warrant that you meet these requirements.

2. Account registration

Some features (including customer accounts and the Brand Partner program) require you to register and create login credentials. You agree to: (a) provide accurate, current, and complete information; (b) maintain the security of your credentials; and (c) accept responsibility for all activities that occur under your account.

3. Orders, pricing, and payment

All product orders are subject to acceptance by us. Prices, availability, taxes, and shipping fees are shown at checkout and may change without notice. We may correct pricing or product errors at any time, including after an order has been placed. Payment is processed through our third-party payment processor; you agree to that processor's terms.

4. Shipping & returns

Shipping timelines, delivery methods, and return rights are described in our Shipping & Returns Policy, which is incorporated into these Terms. We offer a 60-day satisfaction guarantee on direct purchases — see the policy for full details.

5. Subscriptions

Subscription orders renew automatically on the cadence selected at checkout, charged to your saved payment method, until you cancel. You may skip, pause, or cancel a subscription at any time from your account or by emailing info@moringa.co at least 24 hours before your next scheduled charge.

6. Brand Partner program

Enrollment in the Brand Partner program is governed by our Distributor Agreement and Policies & Procedures. Brand Partner earnings are not guaranteed. Please review the Income Disclosure Statement before enrolling.

7. Health disclaimer

Statements about our products on this Site have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. See our Health Disclaimer for important details.

8. Acceptable use

You agree not to:

  • Use the Services for any unlawful purpose, or in violation of these Terms;
  • Attempt to gain unauthorized access to any portion of the Site or another user's account;
  • Reverse engineer, scrape, or harvest any data from the Site;
  • Upload viruses, malware, or harmful code, or interfere with the proper functioning of the Site;
  • Make health claims about our products beyond what is published by Moringa.co.

9. Intellectual property

All content on the Site — including text, graphics, logos, images, photographs, product packaging, code, and the trademarks “Moringa.co”, “Vital 1”, and related marks — is owned by or licensed to Moringa.co and protected by applicable intellectual property laws. You may not copy, distribute, modify, or create derivative works without our prior written permission.

10. User-generated content

If you submit reviews, comments, photos, or other content (“User Content”), you grant Moringa.co a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, and display that User Content in connection with the Services. You represent that you own or have the right to grant this license.

11. Third-party links and services

The Site may link to or rely on third-party websites, payment processors, fulfillment partners, AI providers, and analytics services. We are not responsible for the content, policies, or practices of any third party. Your interactions with third parties are governed by their terms.

12. AI assistant and receptionist

Our chatbot and AI receptionist provide general product, ordering, and program information. Responses are generated by artificial intelligence and may be inaccurate. Do not rely on AI responses for medical, legal, tax, or financial advice. Transcripts may be stored to improve service quality and respond to your inquiry.

13. Disclaimer of warranties

The Services and Site are provided “as is” and “as available”, without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, or that the Services will be uninterrupted, timely, secure, or error-free.

14. Limitation of liability

To the fullest extent permitted by law, in no event will Moringa.co, its affiliates, officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, or loss of goodwill — arising out of or related to your use of the Services. Our aggregate liability for any claim arising out of or relating to the Services is limited to the amount you paid us in the twelve (12) months preceding the claim.

15. Indemnification

You agree to defend, indemnify, and hold harmless Moringa.co and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your User Content, or your breach of these Terms.

16. Governing law & dispute resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute, claim, or controversy arising out of these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual action in small claims court. You and Moringa.co waive any right to a jury trial and to participate in a class action.

17. Changes to these Terms

We may revise these Terms from time to time. When we do, we will update the “Effective date” at the top. Material changes will be posted on the Site and, where required, communicated by email. Continued use of the Services after a change constitutes acceptance of the revised Terms.
